Text and Images Generated by Artificial Intelligence

Although AI does not have any rights under the Copyright Act, TAFE Queensland is still required to indicate when AI has been used in order to be transparent about authorship. Please refer to the Use of Generative Artificial Intelligence Policy prior to incorporating any AI generated content in training and assessment material.

All AI tools have terms and conditions. Users should check the terms and conditions to ensure that any copyright subsisting in the output is assigned to the user of the platform or they are granted a licence. 

The National Copyright Unit has looked at the terms and conditions of some of the AI platforms and provided a summary:

Generative AI Tool Copyright in the output
OpenAI (Dall-E and ChatGPT) Copyright assigned to the user (to the extent possible under current law).
Midjourney (paid subscription) Copyright assigned to the user (to the extent possible under current law).
Midjourney (free subscripiton) Midjourney grants the user (which will typically be the teacher) a licence to the outputs under a Creative Commons Attribution Non-Commercial Licence CC BY-NC 4.0. You will need to ensure that you comply with the terms of the Creative Commons licence, including the requirement to attribute the copyright owner, when using only the free subscription.

Where there is no assignment of rights from the AI platform, but instead a licence granted (including under Creative Commons), you must ensure that you comply with the terms of that licence, including any requirements regarding attribution

Most AI tools give the user some form of right to ownership of the output, but at the same time, they also give themselves permission to use prompts and the resulting output in any way they choose.

TAFE Queensland intellectual property should not be copied or uploaded to AI tools.

If AI platforms are used to modify existing third-party materials (ie. materials that were not created by TAFE Queensland), users should:

  • only do so if an exception in the Copyright Act or the Statutory Text and Artistic Works Licence applies or obtain permission from the copyright owner, unless TQ already have a licence to modify eg. Adobe Stock
  • attribute content created using the AI platform in the manner set out below
  • comply with the guidance in relation to the licences/exceptions or permission relied on
  • unless the terms and conditions of the particular AI tool explicitly state otherwise, add the appropriate statement where it is clearly visible, or to the footer or Acknowledgements page.

Adobe Stock has added AI generated images to its library. They have "Generative AI" as the contributor name in the image record. 

With Adobe Stock images, attribute in the format : [Contributer Name]/stock.adobe.com. Used with permission.

Do not include the AI disclaimer statement/label for any images from Adobe Stock as these images are simply sourced from their image library and TAFE Queensland staff is not involved in the creation of any of them.

Microsoft Copilot may be accessed by TAFE Queensland staff via single sign-on. Visit Microsoft Copilot on SPOT to learn more.

When you enter a prompt Copilot will generate a response that includes links to its sources. Review the response and sources to ensure that Copilot’s output is valid.

For example, using the prompt: "step by step instructions on how to brush your teeth properly", Copilot generated :

You could then click on the source links, write your own steps and attribute the sources as you normally would.

But if you choose to use the Copilot response with minimal editing, you should attribute in this format:

How to brush your teeth properly

  1. Choose a soft-bristled toothbrush and a fluoride toothpaste and use a pea-sized amount of toothpaste,
  2.  Hold your toothbrush at a 45-degree angle to your gum line and gently brush each tooth using circular or short back-and-forth motions. Make sure to clean the front, back, and top surfaces of each tooth.
  3. Brush your tongue from back to front to remove bacteria and freshen your breath.
  4. Spit out the toothpaste and rinse your mouth with water or a fluoride mouthwash.
  5. Brush your teeth at least twice a day, preferably after breakfast and before bed, for at least two minutes each time.

Adobe Firefly is a generative AI tool in which you enter simple text prompts to create images, text effects and fresh colour palettes.
When used to develop teaching and learning resources, Adobe Firefly outputs need to be attributed with Firefly name and version and include the AI disclosure statement in situ, in the footer or Acknowledgements section.
