Useful Websites:

The following are examples using the Harvard system of referencing:

For further examples of Harvard Referencing, go to the Referencing (TAFE) guide.

Note: All legal sources are cited in-text by title and referenced as if in print even if viewed electronically- i.e. there is no need to reference the website.

Legislation:

The format for both in-text citation and the reference list is as follows: Title of the Act Year or Title of the Act Year (abbreviation of the jurisdiction)

Aerodrome Landing Fees Act 2003 (Vic)

Legal Cases:

The in-text format is as follows: Name of the case (abbreviated title)

Note: If a case is known by an abbreviated title include this in the first in-text citation. The abbreviated title can then be used in future citations.

Commonwealth v Tasmania (Tasmanian Dam Case)

For specific page reference: use the word 'at' instead of p.

Namoa v The Queen at 9

The reference list format is as follows: Name of the case (Year of decision) volume of report series  report series abbreviation  starting page number (Abbreviated title)

The State of New South Wales v The Commonwealth (1915) 20 CLR 54 (Wheat Case)

Namoa v The Queen (2021) HCA 13 at 9

Reference Lists:

Some universities and training organisations only include legal cases and legislation in reference lists if they are important to an understanding of the work.  In that case, it is preferable to list them separately under the heading "Cases" or "Legislation".

Other organisations require you to list all works together in the reference list.

It is vital that you clarify points such as these with your teacher if you are unsure which system they prefer.

The latest advice (June 2021) is that TAFE Queensland ATP students undertaking Legal Studies must list all works under the Referencing list.  There is no need to use a separate heading for "Cases" or "Legislation".
